How much you should be paid if you are made redundant or dismissed on health grounds
The amount is gross. Income tax is deducted from severance pay, but no social or health insurance contributions are paid on it.
When severance pay is due
The right to severance pay (in Slovak odstupné) arises under § 76 of the Labour Code if the employment ends by notice from the employer or by agreement between the parties, and the reason is one of the following:
- the employer is being wound up or is relocating and the employee does not agree to work at the new location;
- the employee has become redundant because of organisational changes;
- the employee has, according to a medical opinion, lost the long-term ability to do their job;
- the employee cannot do the job because of a work injury, an occupational disease or having reached the maximum permitted exposure at the workplace.
If you resign of your own accord, or you are dismissed for a breach of discipline, no severance pay is due.
Amount by length of service
Where notice is given by the employer:

If the employment ends by agreement between the parties for the same reasons, severance is one band higher: up to 2 years — one monthly wage, 2 to 5 years — two, 5 to 10 — three, 10 to 20 — four, 20 years or more — five.
A special case: work injury
If an employee cannot do their job because of a work injury, an occupational disease or the threat of one, severance pay is at least ten times the average monthly wage. Length of service and the way the contract ends make no difference here. The exception is where the injury was the employee’s own fault.
What counts as average monthly earnings
This is not the salary stated in your contract. Average earnings are calculated under § 134 of the Labour Code from the pay accrued in the previous calendar quarter. Bonuses and supplements are included, so the figure is usually higher than your basic salary.
When it must be paid
The employer must pay severance on the first payday after the employment ends. If they fail to do so, interest for late payment is added to the amount.

Are contributions paid on severance pay?

I have been offered to leave by agreement between the parties. Is that better for me?
For the same grounds for termination, severance under an agreement between the parties is one band higher. But it matters that the agreement states an organisational reason or state of health as the reason — without that wording, no right to severance arises.
Can I take the severance pay and register as unemployed straight away?
Yes, severance pay does not remove your right to unemployment benefit. For the conditions of registering, see the website of the Labour Office (Úrad práce).
My employer has not paid the severance. What can I do?
First ask the employer for payment in writing, then you can turn to the National Labour Inspectorate (Národný inšpektorát práce) or to a court. The claim does not expire immediately — the general limitation periods apply to employment disputes.
