How much leave the law gives you

The basic holiday entitlement in Slovakia is 4 weeks. On a normal five-day working week that is 20 working days a year. If you work six days a week, the entitlement is recalculated: 4 weeks becomes 24 days.

5 weeks (25 days on a five-day week) apply if you turn 33 during the calendar year. An important detail: the month of your birthday makes no difference. If you turn 33 on 28 December, the higher entitlement applies for the whole year.

The same 5 weeks apply to an employee under 33 who permanently cares for a child.

The 60 working days condition

You become entitled to leave for the calendar year if you have worked at least 60 days for one employer that year. With less service you get leave for the days worked: one twelfth of the annual entitlement for every 21 days worked.

If you have not worked the full year

If you change jobs during the year, leave is calculated proportionally: one twelfth of the annual entitlement for each full month worked. Part days are rounded up to the nearest half day.

How holiday pay is calculated

For days of leave you are paid not your salary but your average earnings, calculated under § 134 of the Labour Code from your pay in the previous calendar quarter. Average earnings include bonuses and supplements, so they often work out higher than base salary alone.

Untaken leave

Leave is primarily meant for rest, so you cannot simply take the money instead of the time off. Compensation is paid only when the employment ends — or for the part of the leave above four weeks that could not be taken for reasons on the employer's side.

I turn 33 in December. Do I get five weeks straight away?

Yes. The entitlement is set by the age you reach during the calendar year, not by your date of birth.

I have worked only 4 months and I am leaving. What happens to my leave?

If you have worked more than 60 days, you are entitled to a proportional share — one twelfth of the annual entitlement for each full month. The employer must pay you for any untaken days in your final settlement.

My employer is sending me on leave without my agreement. Is that allowed?

The employer sets the timing of leave after discussing it with the employee, but must give at least 14 days' notice of it. That period can be shortened only with the employee's agreement.

Does sick leave count as time worked?

Periods of temporary incapacity for work generally do not count as time worked for holiday purposes, and after a long period of sick leave the entitlement may be reduced.
